Welcome to EAM Global’s online payment portal. By using this service, you agree to comply with the terms and conditions outlined below.
1. Direct Payment Requirement
The Client must make the online payment directly and not through any third party. EAM Global and its associated companies (hereinafter referred to as “EAM Global”) will not be responsible for any loss or liability arising from the disclosure of debit card/credit card or bank account details to any third party by the Client during the payment process. If the Client is unable to make the payment, a third party may do so on behalf of the Client. In such cases, both the Client and the third party will be bound by the additional terms mentioned in the attached Declaration.
2. Evidence of Payment
The records of EAM Global, whether computerized or otherwise, regarding payments shall be accepted as conclusive evidence of the genuineness and accuracy of such payments. These records can be used as evidence in any legal proceedings.
3. Service Provider and Bank Performance
The online payment facility relies on the performance and speed of the service provider’s and respective bank’s servers and IT infrastructure. EAM Global does not guarantee server uptime or transaction success time and shall not be responsible for the success or failure of transactions. However, in the event of a double charge due to a technical issue, EAM Global will refund the duplicate charge without interest or other levies.
4. Client Responsibility
The Client is solely responsible for executing transactions and must not share confidential information related to Credit Card / Debit Card / Internet Banking / Cash Card with anyone. EAM Global will not be liable for any misuse of such information. The IP address of the Client will be tracked by EAM Global, and any misuse of the payment gateway with fraudulent intent will result in penal action.
5. Adequate Funds
The Client must ensure that their account has adequate funds to ensure transaction success. Any charges or levies by the service provider or bank due to an unsuccessful transaction caused by insufficient funds in the Client’s account will be recoverable from the Client.
6. Limitation of Liability
EAM Global will not be responsible for any damage or loss incurred by the Client as a result of financial transactions on the EAM Global website. EAM Global will not be liable for fraudulent use or misuse of the Client’s Credit Card / Debit Card / Internet Banking / Cash Card by a third party. Furthermore, EAM Global will not be responsible for any errors, defects, loss of profits, or consequential losses arising from the Client’s use of or inability to use the online payment services. EAM Global will assist the Client in recovering amounts lost due to reasons other than their own fraudulent actions or misuse.
7. Reversal of Charges
Any reversal of charges paid online will depend entirely on the payment gateway’s terms and conditions. EAM Global will not be liable for any delays in the reversal of charges.
8. Payment Gateway and Bank Terms
All payments are subject to the terms and conditions of the payment gateways and banks. By using this service, the Client agrees to be bound by these terms and conditions and will not hold EAM Global responsible for any non-compliance.
9. Amendments to Terms and Conditions
EAM Global may make alterations, additions, or deletions to these terms and conditions from time to time. These changes will take effect from the date they are communicated by EAM Global.
10. Unlawful Use
The Client must not use these services for any unlawful or prohibited purposes. The Client must take all necessary precautions to prevent unauthorized and illegal use of the services and must not disclose details of their Credit Card / Debit Card / Internet Banking / Cash Card to anyone.
11. Suspension or Termination of Services
EAM Global may suspend or terminate the online payment services due to operational difficulties. The Client will be responsible for any transactions made through the services until the time of such termination.
12. Contractual Agreement
These terms must be read in conjunction with the terms and conditions mentioned in the contract signed by the Client with EAM Global.
13. Governing Law
These terms shall be governed by the applicable laws in the UAE. Any disputes arising out of these terms will fall under the jurisdiction of the courts in Dubai, UAE.
